ORTEX Charts Community End User Licence Agreement

This Community EULA (the "EULA") lets you use ORTEX Charts (the "Software") free of charge for the purposes below. By requesting a Community key or kit, or by using the Software without a paid plan, you accept this EULA. It is between you and ORTEX (entity to be confirmed by counsel).
1. What you may do
You may integrate and run the Software in:
- (a) personal, educational and research projects;
- (b) internal evaluation and prototypes, for up to 90 days per organisation, to decide whether to buy a plan;
- (c) open-source projects published under an OSI-approved licence, provided the Software itself is not included in the published source (it is loaded from the ORTEX kit or registry);
- (d) non-commercial websites and applications, meaning those that do not charge users, carry paid advertising, sell products or services, or form part of a business's operations.
If your use does not fit (a) to (d), you need a paid plan under the ORTEX Charts Software Licence Agreement.
2. What you must do
- Keep the "Charts provided by ORTEX" mark visible and unaltered, with its link.
- Use only the Community key or kit issued to you, on the domains you registered (
localhostis always allowed). - Comply with the restrictions in Section 3 of the Software Licence Agreement, which apply here in the same way (no reverse engineering, no redistribution, no circumventing the key check or the mark, no building a competing charting library).
3. What you get
The current version of the Software through the hosted kit, updated automatically; the documentation; community support through the public channels we operate. No warranty, no service levels, no indemnity. The Software is provided "as is" for Community use and ORTEX's liability to you is limited to the maximum extent the law allows.
4. Data
The Software verifies your key in the browser and sends no end-user data to ORTEX. Our content delivery network logs the requesting domain, kit identifier, version and time for each kit request, to serve registered domains and to operate the service.
5. Changes and termination
We may change this EULA or withdraw Community use with 30 days' notice on ortexcharts.com. We may end your Community key at any time if you breach this EULA. You may stop using the Software at any time.
6. General
Sections 9, 12 (as limited above), 14 and 15 of the Software Licence Agreement apply to this EULA as if set out here.
Open questions for counsel: whether the 90-day evaluation limit is enforceable and desirable; the definition of non-commercial; whether open-source projects should be allowed to bundle the Software (currently no, to keep distribution under our control).
